AGREEMENT TO TERMS

This website is owned and operated by Tranquil Wicks LLC. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors a selection of products including candles, wax melts, body sprays, lotions, room and fabric sprays, hand sanitizers, and customized candles, along with engaging blogs discussing candle care, self-care topics, and interactive member feedback, reviews, and comments. By accessing or using our website, you confirm that you have read, understood, and agree to be bound by these Terms.

We are registered in New York, United States and have our registered office at 273 Linden Street, Apt 2BL, Brooklyn, NY 11237. You agree that by accessing the Site, you have read, understood, and accepted all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND MUST DISCONTINUE USE IMMEDIATELY.

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it; (ii) you enter into a legally binding contract to purchase an item when you commit to buy it and complete the checkout payment process.

The prices we charge for using our services and for our products are listed on the website. We reserve the right to change our prices for products displayed at any time and to correct pricing errors that may inadvertently occur. The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged monthly to your payment method.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, at our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms, and you waive any right to receive specific notice of each change. Please ensure that you check the applicable Terms every time you use our Site to understand which Terms apply. USER REGISTRATION

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

PRODUCTS

We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.

PURCHASES AND PAYMENT

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in U.S. dollars.

By placing an order, you agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. If your order is subject to recurring charges, you consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge until such time as you cancel the applicable order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

We reserve the right to refuse any order placed through the Site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

RETURN POLICY

At Tranquil Wicks, we strive to ensure our customers are completely satisfied with their candle purchases. If your order arrives damaged or unusable, please contact us at WeCare@TranquilWicksLLC.com, and we will provide you with instructions on how to return your purchase.

Return Guidelines:

To qualify for a full refund, items must be returned within 30 days of purchase.
Items must be returned in new, unused condition, including original packaging and all accessories.
Please note: We will not accept returns of candles that have been lit.

Refund Process: We will notify you once your return is received and inspected regarding the approval or decline of your refund. If approved, your refund will be processed, and a credit will be applied to the original payment method.

Missing or Late Refunds: If you haven’t received your refund yet, please first check with your bank or credit card company, as it may take time for your refund to officially post to your account. Sale Items: Only regular-priced items are eligible for refunds. Sale items are non-refundable.

Exchanges: Exchanges will only be processed for damaged or defective items.

PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a user of the Site, you agree not to:

USER GENERATED CONTRIBUTIONS

The Site may provide you with opportunities to create, submit, post, display, transmit, perform, publish, or distribute content and materials (collectively, "Contributions"). Contributions may be viewable by other users and through third-party websites, and any Contributions you transmit may be treated in accordance with our Privacy Policy.

When you make available any Contributions, you warrant that:

The accessing, downloading, or copying of your Contributions does not infringe on any proprietary rights.
You have the necessary licenses and rights to use and authorize us, the Site, and other users to use your Contributions in any manner contemplated by the Site and these Terms.
Your Contributions are not untrue, misleading, or otherwise violate any applicable law or regulation.
Your Contributions do not include any offensive comments related to race, national origin, gender, sexual preference, or physical disability.

CONTRIBUTION LICENSE

You grant us a non-exclusive, royalty-free, worldwide, fully paid, perpetual, irrevocable, and transferable license to use, reproduce, modify, publish, distribute, create derivative works of, and publicly display your Contributions in any media now known or hereafter devised, for any purpose, including promoting and redistributing parts of the Site and the marketing of our products and services. You retain all ownership rights to your Contributions and have the right to create your Contributions and grant the above license. We are not liable for any statements or representations in your Contributions provided by you in any area on the Site.

GUIDELINES FOR REVIEWS

We may provide you areas on the Site to leave reviews or ratings. When posting a review, you must comply with the following criteria:

You should have firsthand experience with the product or service being reviewed.
Your reviews should be free of offensive profanity and abusive language.
Your reviews should not contain discriminatory references based on religion, race, gender, national origin, or any other protected status.
Your reviews must not imply or state any illegal activity.
You should not be affiliated with competitors if posting negative reviews.

LIMITATIONS OF LIABILITY

To the fullest extent permitted by applicable law, Tranquil Wicks LLC and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, loss of data, or other intangible losses, arising out of or related to the use or inability to use our products or the Site, even if we have been advised of the possibility of such damages.

The total liability of Tranquil Wicks LLC for any claims arising out of or connected with the products purchased or the use of the Site shall not exceed the amount paid by you for the specific product at issue.

By purchasing our products, you acknowledge that you understand and agree to these limitations of liability. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you..

INDEMNIFICATION
